1. IMPORTANT NOTICE REGARDING AGE VERIFICATION AND DATA COLLECTION

THIS SOFTWARE PERFORMS REAL-TIME AGE VERIFICATION USING ARTIFICIAL INTELLIGENCE AND COMPUTER VISION TECHNOLOGY. NO IMAGES, VIDEO STREAMS, OR BIOMETRIC DATA ARE EVER STORED, SAVED, OR TRANSMITTED TO OUR SERVERS. THE SOFTWARE PROCESSES ALL VISUAL DATA LOCALLY IN THE USER'S BROWSER AND ONLY TRANSMITS NON-PERSONALLY IDENTIFIABLE ANALYTICS DATA.

2. ACCEPTANCE OF TERMS

By installing, accessing, or using the AI Age Verification Software ("Software"), you agree to be bound by these Terms of Service ("Agreement"). If you do not agree to these terms, do not install or use the Software.

3. LICENSE GRANT AND RESTRICTIONS

3.1. License Grant: Subject to your continued compliance with this Agreement and timely payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Software solely for your internal business purposes.

3.2. License Duration: The license remains valid only for the duration of your active subscription. Upon termination or expiration of your subscription, all rights granted under this license automatically terminate.

3.3. Restrictions: You shall not Decompile, reverse engineer, disassemble, or attempt to derive the source code of the Software, Modify, adapt, translate, or create derivative works based on the Software, Copy, redistribute, resell, lease, sublicense, or otherwise transfer rights to the Software, Remove or alter any proprietary notices or labels on the Software, Use the Software for any illegal or unauthorized purpose

4. DISCLAIMER OF WARRANTIES

4.1. Age Verification Accuracy: THE SOFTWARE UTILIZES ARTIFICIAL INTELLIGENCE TO ESTIMATE AGE, AND WHILE IT EMPLOYS ADVANCED TECHNOLOGY, WE MAKE NO WARRANTIES OR GUARANTEES REGARDING ITS ACCURACY IN DISTINGUISHING BETWEEN ADULTS AND MINORS. YOU ACKNOWLEDGE THAT NO AI SYSTEM IS 100% ACCURATE AND AGREE TO USE THE SOFTWARE AS AN ASSISTIVE TOOL RATHER THAN A DEFINITIVE AGE VERIFICATION SOLUTION.

4.2. General Disclaimer: THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE EXPLICITLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

5. DATA COLLECTION AND PRIVACY

5.1. Data Collection: The Software collects and transmits the following data: IP address and geolocation data, Browser and device information, Usage statistics and verification attempts, Aggregate age verification results, Website traffic and user interaction metrics.

5.2. Data Usage: Collected data is used for: Improving Software performance and accuracy, Generating analytics and usage reports, Ensuring compliance with regional requirements, Technical support and troubleshooting.

5.3. Data Protection: We implement reasonable security measures to protect collected data. However, no method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.

6. LIMITATION OF LIABILITY

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING BUT NOT LIMITED TO PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; LOSS OF USE, DATA, OR PROFITS; OR BUSINESS INTERRUPTION) ARISING OUT OF OR IN CONNECTION WITH THE SOFTWARE, WHETHER BASED ON CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

7. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless our company, its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney fees and costs, arising out of or in any way connected with your access to or use of the Software.

8. TERMINATION

8.1. We reserve the right to terminate or suspend your access to the Software immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

8.2. Upon termination:

All licenses and rights to use the Software shall immediately terminate. You must cease all use of the Software. You must remove the Software from all websites and systems. 9. GOVERNING LAW AND JURISDICTION

This Agreement shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions. By installing or using the Software, you acknowledge that you have read these Terms of Service, understand them, and agree to be bound by their terms and conditions.
